Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Flapp AI mobile application, website, and related services (collectively, the "Service"). The Service is operated by Flapp Bilisim A.S. ("Flapp", "we", "us", or "our"), Istanbul, Turkey.

By creating an account, purchasing a subscription or TOEFL credit pack, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use Flapp AI. By using the Service, you represent that you are 18 or older and have the legal capacity to agree to these Terms.

2. The Service

Flapp AI provides English learning, AI conversation practice, speech practice, feedback, scoring, progress tracking, and TOEFL speaking practice features.

The Service may include:

• AI-powered chat and speaking practice

• Speech transcription and text-to-speech

• Grammar, vocabulary, fluency, and prosody feedback

• CEFR-style learning feedback and scores

• TOEFL speaking practice tasks and estimated practice scores

• Saved feedback, learning history, and progress tracking

• Subscriptions and one-time TOEFL credit purchases

Flapp AI is an educational practice tool. It is not an official TOEFL test, is not affiliated with ETS, and does not provide official exam scores, admissions decisions, immigration advice, or academic certification.

3. Account Registration

You may need an account to use the Service. You agree to provide accurate information and to keep your login credentials secure.

The app may support sign-in using email/password, Google Sign-In, and Apple Sign-In. You are responsible for all activity that occurs under your account.

You must notify us promptly at support@flapp.ist if you believe your account has been compromised.

4. Subscriptions and Purchases

Flapp AI may offer paid subscriptions and one-time TOEFL credit packs.

Subscriptions may provide access to premium features for the subscription period shown at purchase. TOEFL credit packs provide a set number of TOEFL speaking practice credits. Each full TOEFL speaking practice test may consume one credit.

Prices, billing periods, available products, and included features may vary by country, platform, and time. The final purchase terms are shown by Apple App Store or Google Play before you confirm payment.

5. Billing, Renewal, Cancellation, and Refunds

Purchases are processed by Apple, Google, and/or RevenueCat. We do not process or store your full payment card details.

If you purchase an auto-renewing subscription, it will renew automatically unless canceled through your App Store or Google Play account settings before the renewal deadline required by the relevant platform.

You can manage or cancel subscriptions through:

• Apple App Store account subscription settings

• Google Play subscription settings

Refund requests are generally handled by Apple or Google according to their policies. We cannot guarantee refunds for purchases made through third-party app stores.

6. TOEFL Credits

TOEFL credits are used for TOEFL speaking practice in the app. Credits are not official exam vouchers, are not transferable, and have no cash value.

We may deny duplicate credit grants where the same purchase has already been processed. If you believe your credits were not added correctly, contact support@flapp.ist with your purchase details.

7. AI Responses and Scores

Flapp AI uses artificial intelligence and scoring systems. AI responses, corrections, transcripts, feedback, and scores may be inaccurate, incomplete, delayed, or unavailable.

You understand and agree that:

• Scores are estimates for practice and learning only

• TOEFL practice scores are not official TOEFL scores

• AI feedback is educational support, not professional advice

• You should review important outputs independently

• We do not guarantee any specific learning result, test result, exam score, admission outcome, job outcome, or language proficiency improvement

8. Voice Features

The Service may request microphone access for speaking practice, transcription, voice conversations, and TOEFL speaking tasks.

You are responsible for ensuring that you have permission to record or submit any speech or content you provide. You must not record or submit another person’s voice or personal information without permission.

9. Acceptable Use

You agree not to:

• Use the Service for unlawful, harmful, abusive, fraudulent, or misleading purposes

• Harass, threaten, abuse, impersonate, or harm others

• Submit content that infringes another person’s rights

• Attempt to reverse engineer, scrape, copy, overload, interfere with, or disrupt the Service

• Circumvent payment, access control, subscription, credit, or security systems

• Use automated systems to access the Service without permission

• Upload malware or harmful code

• Use the Service to generate or distribute illegal or harmful content

We may suspend or terminate access if we believe you have violated these Terms or used the Service in a way that creates risk for Flapp, users, service providers, or third parties.

10. User Content

"User Content" means content you submit to the Service, including messages, speech, transcripts, questionnaire answers, TOEFL practice responses, contact messages, and feedback selections.

You keep ownership of your User Content. You grant Flapp a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, and use your User Content as needed to provide, maintain, secure, improve, and support the Service.

You are responsible for your User Content and represent that you have the rights needed to submit it.

11. Intellectual Property

The Service, including software, design, interface, branding, logos, content, learning flows, and other materials, is owned by Flapp or its licensors and is protected by intellectual property laws.

Except as allowed by these Terms, you may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Service.

12. Third-Party Services

The Service relies on third-party services, including Firebase / Google services, Google Sign-In, Apple Sign-In, OpenAI, Azure OpenAI, RevenueCat, Apple App Store, Google Play, and cloud-hosted scoring services.

Your use of third-party services may be subject to their own terms and privacy policies. We are not responsible for third-party services that we do not control.

13. Privacy

Our Privacy Policy explains how we collect, use, store, and share information. By using the Service, you also agree to our Privacy Policy.

14. Account Deletion

You may request account deletion from inside the app where available, or by contacting support@flapp.ist.

Deleting your account may remove your access to subscriptions, credits, saved history, and app features. Deleting the app from your device does not automatically cancel subscriptions or delete all server-side data. You must cancel subscriptions through Apple App Store or Google Play where applicable.

Some records may be retained where required for legal, tax, accounting, fraud prevention, purchase verification, dispute resolution, or platform compliance purposes.

15. Service Availability and Changes

We may modify, suspend, or discontinue all or part of the Service at any time. We may change features, scoring systems, prices, credit rules, or supported platforms, subject to applicable law and platform rules.

We do not guarantee that the Service will be uninterrupted, error-free, secure, or available at all times.

16. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory.

We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, and uninterrupted operation.

17. Limitation of Liability

To the maximum extent permitted by law, Flapp Bilisim A.S. and its directors, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunities.

To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid to Flapp for the Service during the three months before the event giving rise to the claim, or the minimum amount required by applicable law.

Nothing in these Terms limits liability that cannot legally be limited.

18. Indemnity

You agree to defend, indemnify, and hold harmless Flapp Bilisim A.S. from claims, damages, liabilities, losses, and expenses arising from your use of the Service, your User Content, your violation of these Terms, or your violation of any law or third-party right.

19. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, create risk, fail to pay applicable fees, misuse the Service, or if we are required to do so by law or platform rules.

Termination does not automatically entitle you to a refund and does not affect provisions that should reasonably survive termination.

20. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Turkey, without regard to conflict of law principles.

Unless mandatory law provides otherwise, disputes arising from or relating to these Terms or the Service will be subject to the jurisdiction of the competent courts and enforcement offices of Istanbul, Turkey.

21. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may notify you through the app, website, or other reasonable means. Updated Terms become effective when posted, unless otherwise stated.

Your continued use of the Service after updated Terms become effective means you accept the updated Terms.
